Begutachtung des Leistungsvermögens im Antragsverfahren auf Erwerbsminderungsrente
Zusammenfassung: Das Antragsverfahren auf Rente wegen Erwerbsminderung ist ein Prozess von hoher individueller, sozioökonomischer und sozialrechtlicher Tragweite. Dem Gutachter obliegt, vor dem Hintergrund der Sozialgesetzgebung, die Aufgabe, die medizinischen Voraussetzungen für Leistungen zur medizinischen und beruflichen Rehabilitation sowie zur Erwerbsminderungsrente zu prüfen. Im Rahmen der PEgL-Studie wurden mögliche kontextuelle und intrapersonale Einflussfaktoren auf die gutachterliche Einschätzung der Leistungsfähigkeit untersucht. Die Annahme einer neutralen gutachterlichen Grundhaltung wird für die untersuchte Stichprobe orthopädischer Gutachterinnen und Gutachter durch die Ergebnisse gestützt. Es zeigen sich positive Ergebnisse bezüglich zentraler Aspekte der Urteilsübereinstimmung.
Abstract: Social-medical reasoning on disability pensions is a process of high individual, social, legal and economic impact. There is evidence for variance in social-medical reasoning about the reduction in quantitative working capacity. The study focuses on the reasoning process of medical experts in the context of disability pensions in cases with psychosomatic/psychiatric or orthopedic disorders. It aims at assessing the impact of medical, psychological, interactional and social factors on the estimation of working capacity. We present the results of the orthopedic subsample in this study.In six out of eight cases the percentage of agreement on working capacity ranged from 76,7 to 95,7 percent. For the medical experts the diagnostic findings seem to be the most important influencing factor for estimation of working capacity.
